Diffuse Mesothelioma Payment Schemes

If you have been diagnosed with the Asbestos-related illness Diffuse Mesothelioma then you may be entitled to a payment ranging anywhere from £13,590.00 to £271,120.00. There are two different Schemes available to claim under but both are very different in terms of their scope and application.

The first of the two Schemes is the Diffuse Mesothelioma Payments 2008 Scheme. It is open to applicants who believe that their exposure to Asbestos was not caused by work or training. Under this scheme an applicant must bring their claim within 12 months of being diagnosed and the exposure must have occurred within the United Kingdom. You cannot claim under this Scheme if you have been given a payment for your illness by an employer a civil claim or elsewhere.

The Diffuse Mesothelioma Payment Scheme (DMPS) is the second of the two available Schemes and unlike the first is only open to applicants whose exposure to Asbestos occurred during the course of employment. The scheme is also only open to applicants who have not been able to trace their previous employer or their insurer and were diagnosed with Diffuse Mesothelioma on or after 25 July 2012. Under this scheme a claimant must bring their claim within 3 years of being diagnosed and again the exposure must have occurred within the United Kingdom.

It is possible for you to claim for DMPS even if you have claimed under the 2008 Scheme and have received payments. Any payment that is made under the DMPS will then have deducted from it any payments that have already been made under the 2008 Scheme. It is also possible that you can still claim under the 2008 Scheme if you have been unsuccessful at claiming DMPS.

Under both Schemes it is possible to claim payments as a dependant of somebody who has died from Diffuse Mesothelioma caused by exposure to Asbestos. Claims must be bought within 12 months of the death and payments under the 2008 Scheme range from between £7,500.00 to £27,500.00 depending on the age of the person who died as a result of expose.
