There is only one ground for a Divorce and that is that the parties’ marriage has irretrievably broken down. To prove this you (the Petitioner) will need to prove one of five facts within your petition –

A)    That your husband/wife has committed adultery and that you find it intolerable to live with him/her.

B)     That your husband/wife has behaved in such a way that you cannot reasonably be expected to live with him.

C)    That your husband/wife has deserted you for a continuous period of at least 2 years immediately proceeding the presentation of the divorce petition.

D)    That yourself and your husband/wife have lived apart from continuous period of at least 2 years immediately proceeding the presentation of the divorce petition and that you or your husband/wife consent to the Decree being granted.

E)     That yourself and your husband/wife have lived apart for a continuous period of at least 5 years immediately proceeding the presentation of the petition.
