Success in Care Home Fees Negotiation
Following last year’s landmark Judicial Review case involving Pembrokeshire County Council and its care home fee rates, Josiah Hincks Partner Andrew Eagle was involved in consultation with Conwy Borough Council. He was part of the Council’s Task and Finish Group in his capacity as a director of a care home and also provided advice to the other care home owners that made up the group. The Group worked with the Council in using the Laing and Buisson toolkit as provided by the Welsh Assembly for working out the fair fees. During the discussion group meetings the Group put forward a number of arguments to the officers as a result of which on 26th October in a session of the full council Conwy raised its fee for Residential Care by a significant 30% and fully back dated the increase to 1st April 2011.
Andrew has been advising care homes for over 10 years and is fully conversant with the requirements of both the Care Standards Act and depending upon location the standards set down by Care Quality Commission (CQC) or the Care Standards Inspectorate for Wales (CSIW). He is able to advise on all aspects of regulation and management of a care establishment.
Changes to Unfair Dismissal Qualifying Period and Employment Tribunal Fees
George Osborne, the Chancellor, has announced two very important changes to Employment Law which are aimed at reducing the number of employment tribunal claims. Mr Osborne was speaking at the Conservative Conference on 3rd October 2011.
Firstly, an employee will need to have been employed for 2 years (the qualifying period) rather than the current 12 months.
Secondly, fees will be introduced for commencing Tribunal Claims. It appears as though the following fees will apply:
The financial test is yet to be set down by the Government, as is the legislation proposing these changes. For instance, if the test is that a person on Job Seekers Allowance gets a fee remission, then most people unfairly dismissed will still be able to bring employment tribunal proceedings for free.

Josiah Hincks recently acted for Baker Richmond in the transfer of their business to Berkeley Burke (Holdings) Limited in anticipation of the retirement of two of their three partners. The deal means that Baker Richmond’s 3500 clients and their £70 million of “funds under influence” will now be managed by Berkeley Burke’s wealth management division.
Clive Baker said “there had been a couple of previous attempts to make such a move but we had found it difficult to take these forward due in the main to the current economic climate. Throughout the process, Andrew Eagle, partner at Josiah Hincks has been working closely with and advising us. His help and input was invaluable as he gave us not just legal but sound business advice that enabled us to bring this matter to a successful conclusion. We elected to sell the business to Berkeley Burke because their ethos is entirely in line with our own. It was also absolutely vital that we secured a deal that ensured continuity of quality service delivery to our clients”.
